The BC Energy Regulator has approved changes to the Consultation and Notification Regulation, Service Regulation and the Fee, Levy and Security Regulation.

The BC Energy Regulator (Regulator) Board has approved changes to the Consultation and Notification Regulation, Service Regulation and the Fee, Levy and Security Regulation. These changes will come into effect on June 1, 2021. Some of these changes are summarized below:

Consultation and Notification Regulation:

  • The previous Consultation and Notification Regulation has been repealed and replaced with a new Requirements for Consultation and Notification Regulation.
  • Definitions have been updated, including:
    • The definitions of “land owner” and “rights holder”.
    • The definition of “major amendment” has been removed; but is still retained, with some modifications, in the Fee, Levy and Security Regulation.
  • Activities relating to distances for notification and/or invitations to consult have been streamlined.
  • Timelines for a response period have increased from 21 days to 30 days.
  • Requirements around invitations to consult for revisions have been updated.

Service Regulation:

  • Timelines for the prescribed method of service, under s.2(2)(a) (ordinary or registered mail) has increased from five days to 14 days.
  • Electronic transmission methods are more inclusive, to enable, for example, service via web portal.

Fee, Levy and Security Regulation:

  • The definition of “major amendment” has been streamlined.

The Regulator will be providing two industry training sessions, March 16 and March 23, 2021. These training sessions will include information on the regulatory framework and new application requirements. Applicants and their representatives are encouraged to attend one of the two training sessions being offered. In order to attend, applicants must pre-register by e-mailing Kristen.Parker@bcogc.ca with their contact information and preferred date. Additional sessions may be scheduled, if required.
